- Reschedule or cancel free of charge until 7 days before the session; later rules are in article 7.

- Consumers may have a statutory cooling-off period where applicable; we aim to resolve disputes in dialogue first.
1. Who we are
These terms apply to all services of Milepostvivo B.V. (the studio or we), a private limited company (B.V.), Helmersstraat 73, 1054 CV Amsterdam, KvK 77461366, VAT NL863072203B01. Contact: [email protected], 020 244 8619. We operate the Milepostvivo recording studio for vocal recording, band recording, mixing, mastering and podcast recording.
These terms apply alongside any specific terms in a quote. If they conflict, the quote prevails except where mandatory consumer law says otherwise. Our privacy policy and, for business clients supplying third-party data, the data processing agreement inform you but do not change these terms unless explicitly agreed in writing.
2. Definitions
| Term | Meaning |
|---|---|
| Client | The natural or legal person accepting a quote. |
| Consumer | A client acting for purposes outside trade or profession. |
| Business client | A client acting in the course of trade or profession. |
| Quote | Written offer with description, date, price, deposit and any specifics. |
| Session | The reserved studio time or agreed remote work. |
| Deposit | 30% of the agreed amount incl. VAT to confirm booking. |
| Working day | Monday to Friday, excluding public holidays in the Netherlands. |
3. Quotes, booking and response time
Send a request via contact, email or phone. We aim to send a quote within 2 working days. Unless stated otherwise, a quote is valid for 2 working days. A slot is firmly booked after written acceptance and receipt of the deposit. Until then we may assign the slot elsewhere.
For distance contracts we confirm booking on a durable medium (email) with essential details. We may refuse a request for a legitimate reason, such as unsafe conditions, incompatible material or more than 6 people on the live floor.
4. Prices and website guides
Services pages show guide prices incl. 21% VAT, for example:
| Service | Rate (incl. VAT) |
|---|---|
| Vocal recording | €89 / €329 |
| Mixing | €195 / €79 |
| Mastering | €99 / €449 |
| Band recording | €129 / €899 |
| Podcast recording | €75 / €139 |
The accepted quote price is binding. Extra time or options agreed during the session are confirmed in advance and invoiced at the quote rate or current hourly rate. Business clients may see net amounts on invoices (e.g. €73.55 excl. VAT per vocal hour).
5. Deposit and payment
The deposit is 30% of the total incl. VAT and is offset against the final invoice. Pay by bank transfer; cash in the studio is limited to legal thresholds. The balance is due before the end of the session or before delivery of final files unless the quote says otherwise.
Business clients pay within 14 days of invoice date unless other terms are agreed in writing that meet fairness and transparency rules. Late payment may incur statutory commercial interest and reasonable collection costs where permitted. Until full payment we may withhold final masters; session archive follows article 11.
6. Reschedule and cancellation by the client
| Timing | Effect |
|---|---|
| More than 7 days before | Free reschedule or cancellation; deposit refunded within 14 days if cancelled. |
| Within 7 days down to 72 hours | Deposit moved once to a new date within three months; otherwise forfeited. |
| Less than 72 hours or no-show | Deposit and any remaining fees due, except force majeure. |
Send requests in writing to [email protected]. Late arrival shortens the session without refund if the next slot is booked. These rules do not reduce consumer rights where law is more favourable.
7. Cooling-off for consumers
As a consumer you may withdraw from a distance contract within 14 days without giving reasons, where the law allows. If you ask us to start before that period ends, a proportionate amount may be due for work already performed if you withdraw later.
The cooling-off right does not apply to services fully performed with your prior express consent and acknowledgment that you lose the right once performance is complete. Fixed-date sessions and bespoke digital deliverables may fall under other statutory exceptions; we explain this in the quote where relevant.
8. Cancellation by the studio
If essential equipment fails, key staff are unavailable or there is an incident on the premises, we notify you as soon as possible and offer another date. If you decline, we refund all amounts received for that session within 14 days. We do not swap engineers without discussion except in force majeure.
9. Sessions and house rules
Opening hours: Monday–Friday 10:00–22:00, Saturday 10:00–18:00, Sunday closed.. Up to 6 musicians at once on the live floor. Participants under 16 need written consent from a parent or guardian who books and pays; a responsible adult stays present throughout.
Treat rooms and gear with care and follow engineer instructions. No smoking or vaping indoors. We may pause or stop a session if people or equipment are at immediate risk; the booked time remains due unless we caused the issue. Damage through intent or gross negligence to studio property is charged to you. Your own instruments stay at your risk; insurance is recommended.
Practical guides are in our guides hub, e.g. band load-in or vocal session prep.
10. Files, delivery and archive
Unless the quote says otherwise, we deliver uncompressed WAV files via a secure download link or on your medium. Mix and mastering timelines start once we receive complete, usable source files.
We keep session and project files for 24 months after the last activity on that job, then delete them unless you order extended storage in writing. You are responsible for backups within that period. Our disclaimer notes that online tips do not guarantee compatibility of your DAW export.
11. Revisions
Mixing and mastering include 2 revision rounds as described on each service page. One round is a single bundled list of notes processed in one pass. Extra rounds or a new artistic direction after approving an intermediate version are quoted as additional work.
12. Intellectual property
Your material. Compositions, lyrics, samples and other input remain yours or your licensors’. You warrant you have rights to record and have us mix or master, including sample and cover clearance. The studio claims no copyright in your works.
Recordings. When you commission and pay for recording, you are generally the producer of the phonogram under Dutch law. To the extent the studio could claim rights in recordings you paid for, it assigns them upon full payment.
Portfolio. We do not use excerpts, session photos or artist names in marketing without written consent.
AI. We do not use client recordings to train AI models and do not create voice clones without specific written consent from the person concerned.
13. Liability
We perform work with the care expected of a professional studio. Artistic outcomes also depend on your preparation and choices; we give no result guarantee. Our liability is limited to direct damage from attributable breach, except for intent, wilful recklessness or personal injury.
For business clients total liability per job is capped at the invoice amount incl. VAT for that job unless mandatory law says otherwise. Indirect loss such as missed exploitation or profit is excluded where permitted.
14. Force majeure
Neither party must perform if prevented by force majeure such as power failure beyond our control, network outage, government measures or serious illness of essential staff. The affected party informs the other and reschedules where possible. If prevention lasts more than 28 days, either party may terminate; we refund prepaid amounts for undelivered services.
15. Personal data
We process personal data under our privacy policy. If you supply guest, narrator or band member data as a business client, our data processing agreement applies where needed.
16. Complaints and disputes
Send complaints in writing to [email protected] or by post to Helmersstraat 73, 1054 CV Amsterdam. We respond within 2 working days with a substantive answer or action plan.
Consumers may bring proceedings before the competent court in our district or, where mandatory rules allow, at their place of residence. EU consumers may use the online dispute platform: ec.europa.eu/consumers/odr. We are not obliged to join an out-of-court scheme unless we explicitly offer one later.
17. Governing law
These terms and contracts with us are governed by Dutch law. Consumers living in another EU member state keep protection of mandatory rules of their country of residence.
18. Changes and final provisions
We may update these terms; the version on milepostvivo.digital dated 14 October 2026 applies to new quotes from that date. Existing jobs remain under the version in force at acceptance unless we agree a change in writing and law allows it.
If a clause is void, the rest remains and we replace the void clause with a valid one closest to its purpose. Dutch is the legal language; translations are for convenience.
